HC Dismisses Protection Plea by Divorced Woman & Married Man, Cites Abuse of Legal Process


CHANDIGARH: In a recent legal development, a 49-year-old divorced woman and a 33-year-old married man sought protection for their lives and property through a joint petition filed in the Punjab and Haryana High Court. Justice Alok Jain, presiding over the case, dismissed the petition, citing an abuse of the legal process to conceal what was believed to be an illicit relationship between the two petitioners.

Justice Jain emphasized that the demand for protection could not be entertained in light of the circumstances surrounding the case. He stated that the wife of the male petitioner was, in fact, the victim in this situation, and imposed a fine of Rs. 25,000 upon the petitioners. Additionally, he directed that this fine be deposited into a fixed deposit (FD) in the name of the petitioner’s child.

The Petitioners, residents of Malerkotla, expressed concerns about their safety and claimed that their lives were at risk. The woman, in her plea, asserted that the wife of the male petitioner had visited her residence and leveled false accusations against her. Allegedly, the wife had also issued severe threats. The petitioners urged the court to intervene and ensure their safety and protection of their assets. However, Justice Jain firmly held that the petition was an effort to misuse the legal system to conceal an alleged extramarital relationship. Consequently, the court rejected the protection plea and imposed the specified penalty.
