NAPA Welcomes Punjab & Haryana High Court Decision on Prohibitory Orders

The North American Punjabi Association (NAPA) warmly welcomes the recent decision of the Punjab and Haryana High Court directing Punjab’s Deputy Commissioners to issue prohibitory orders only in genuine and urgent situations. Executive Director Satnam Singh Chahal praised the judgment as a significant step toward safeguarding democratic rights, ensuring administrative transparency, and preventing the misuse of Section 144 and related provisions of the law.

Chahal stated that for far too long, prohibitory orders were being routinely imposed in Punjab without sufficient justification, often extending for months and affecting the fundamental freedoms of citizens. The High Court’s observation that such orders must not be applied in a “mechanical manner” and should only be issued when there is a clear, immediate threat is an important reminder that constitutional rights cannot be curtailed for administrative convenience.

He commended the Court for highlighting how citizens were being charged for minor or vague reasons, and how continuous or prolonged use of prohibitory orders undermines both civil liberties and public trust. Chahal noted that NAPA has consistently raised concerns about excessive and repetitive restrictions imposed under the guise of maintaining law and order. The judgment now sets clear boundaries, ensuring that authorities must justify any such order with proper reasoning and evidence.

Satnam Singh Chahal further stressed that this decision strengthens democratic accountability and protects ordinary citizens from unnecessary hardship. He urged the Punjab government and district administrations to implement the Court’s directions in letter and spirit, to ensure transparency, fairness, and respect for constitutional norms.
